Right of withdrawal

In accordance with the Consumer Protection Act (Zakon o zaštiti potrošača, Official Gazette NN 19/22) and the Ordinance on the content and form of the notice on the consumer’s right of withdrawal (Pravilnik o sadržaju i obliku obavijesti o pravu potrošača na jednostrani raskid ugovora, NN 117/2022), we inform you of your rights when buying from our online shop.

Withdrawal period

You may withdraw from the contract within 14 days without giving any reason.

To exercise the right of withdrawal, you must inform us of your decision to withdraw from the contract before the period expires, by an unequivocal statement sent by post or email, stating your name and surname, address, and phone number or email address. You may also use the attached withdrawal form.

The 14-day period begins on the day on which you, or a third party other than the carrier indicated by you, acquire physical possession of the goods.

If you order multiple goods in one order that are delivered separately, or goods delivered in several shipments, the 14-day period begins on the day on which you, or a third party other than the carrier indicated by you, acquire physical possession of the last item or the last shipment.

How to withdraw from the contract

You can withdraw from the contract electronically, just as easily as you concluded it:

We will send you confirmation of receipt of your withdrawal by email without delay.

Refund

If you withdraw from the contract, we will refund all payments received from you, including the costs of delivery, without undue delay and in any event no later than 14 days from the day on which we received your decision to withdraw, except where you chose a type of delivery other than the least expensive standard delivery offered by us.

We will make the refund using the same means of payment you used for the initial transaction. If you agree to a different means of refund, you will not incur any fees as a result of the refund.

We may withhold the refund until we have received the goods back or until you have supplied evidence of having sent the goods back.

Returning the goods

Please send back or hand over the goods to us at Brlog zadružna pivovara, Andrije Hebranga 6, 23000 Zadar, Croatia, without undue delay and in any event no later than 14 days from the day on which you communicated your decision to withdraw from the contract.

The deadline is met if you send back or hand over the goods before the period of 14 days has expired.

Cost of returning the goods

You will bear the direct cost of returning the goods.

Liability for diminished value of the goods

You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Exceptions to the right of withdrawal

In accordance with Article 86 of the Consumer Protection Act, the consumer does not have the right of withdrawal where, among other things, the contract concerns:

  • goods that are liable to deteriorate or expire rapidly,
  • goods made to the consumer’s specifications or clearly personalised,
  • sealed goods which are not suitable for return due to health protection or hygiene reasons, if they were unsealed after delivery.

Note: The craft beer we sell in our online shop has a best-before date stated on each product. As beer may deteriorate depending on storage conditions, whether the right of withdrawal applies is assessed for each product individually, taking into account its best-before date and nature.
